Ensuring Right-to-Know and Better Safety for Women Workers

WHAT WILL AB 647 (KALRA) DO?
1. Require any manufacturer of any hazardous substance or mixture of substances constituting a cosmetic or disinfectant, who is obligated to prepare a Safety Data Sheet under federal and state law, to post each Safety Data Sheet to a website where it is publicly accessible.
2. Require manufacturers to translate those Safety Data Sheets into relevant languages for the beauty care industry including Spanish, Vietnamese, Chinese, and Korean.

PROBLEM:
It is often difficult to impossible for salon owners and workers to obtain Safety Data Sheets (SDS) and access the information they contain. SDSs contain essential information on health impacts of hazardous substances in products and
safety precautions to be taken when using those products, among others.

Federal and state labor law requires manufacturers of any product with a hazardous chemical to create Safety Data Sheets and distribute them to direct purchasers. Employers are legally obligated to make them available to their employees, regardless of the extent or complexity of the chain of distribution from manufacturer to employer. There is no legal requirement that SDSs be made available virtually – only as hard copies – creating great potential for SDSs to get “lost in the shuffle” of product distribution.
